I was selling AVG anti-virus on eBay UK.

It was the OEM but i was listing it with a sata data cable to keep inline with the OEM policy.

I received an e-mail from eBay saying that AVG requested it was removed. I spoke to AVG who say allthough it was listed in the correct way i cannot sell it on eBay unless i am one of there registerd resellers.

Is this legal as they sell into distributors where i buy from so surley that means i am able to sell it where i want to ???

True but can they stipulate the sales platform ??? As it says nothing about it in the OEM agreement or in their own T&C'S

Manufacturers can stipulate restrictions on where their goods are sold. Many do so to protect the value of their brand. In this case it seems AVG think that the incredibly cheap prices that can be found on ebay may serve to "cheapen" their product.

I understand that some brands do it and make it a point of their T&C'S when you sign up for them but if they are for genral distribution (i.e i did not source from AVG direct but through a distributor who buys from them) then is it still imposable ???

Most of the "brands" not allowed from eBay you have to source direct from the brand for this to come into force.

Most of the "brands" not allowed from eBay you have to source direct from the brand for this to come into force.

Basically, its up to the manufacturer. The distributor you got them from may have signed up to T&Cs which prohibit sale on eBay and risk losing their supply if they allow others to sell on there. That's their decision to make but if a manufacturer contacted me to say they don't want me selling on ebay I would abide by that and let my supplier know about it too just so they are aware.

I can see your point i will speak to my distributor and see if any such agreements are in place.  thumbs up

Many brands these days view Ebay with utter distaste, there is a very good reason for this, you may be selling the genuine product, listed correctly and everything else right but you will be surprised at how many susposedly genuine products sold on ebay are actually fakes, it is endless the amount of fakes on there. Recently there was that case of fake professional golf clubs, so it isn't just Loius Vuitton bags that are sold on there as genuine when they are fake. It is always best to check with a supplier before you list an item to see if you can sell on auction sites, as brands will protect their intellectual rights by having items removed. I think it is always wiser to have a chat with your supplier first before you list, as if they are removed I bet you Ebay will still charge you for it.
